NOTE REGARDING ANTIQUE IVORY AND TORTOISE SHELL ITEMS. There seems to be no end to misinterpretation of laws regarding commerce in antique items with ivory or tortoise shell materials used in whole or in part (antiques being over 100 years in age), even within the various Depts of Wildlife, USA and California, and yet we try to be sure we are in compliance. In 1983, the US Court of Appeals, Ninth District (Sacramento, CA) ruled against the State of California regarding their stricter guidelines on ivory, in particular, and the endangered species rules, in general as applied by the State of California's statute, in the following case: 702 F.2d 760: Man Hing Ivory and Imports, Inc., a California Corporation,plaintiff-appellee, v. George Deukmejian,* Governor of the State Of California, et al., Defendants-appellants, United States Court of Appeals, Ninth Circuit. - 702 F.2d 760, Argued and Submitted Aug. 11, 1982. Decided March 11, 1983. This finding seems to render the recent article published in Maine Antique Digest, and controversy surrounding same, moot, and suggests keeping our Utah office open may not be necessary, so we are researching further. Meanwhile, you will please note that any items with either ivory or tortoise shell are not stored or shipped from our California office, and will by necessity be only dealt out of our Utah store. Where this creates any slight delay, or the division of shipping for a multiple item order, we apologize. We continually try to comply with California State laws that are at variance with US Dept of Wildlife regulations. Your patience is greatly appreciated.
